Drug Testing Laws in the State of MontanaDrug Testing Montana's drug testing statute was repealed in 1997 and replaced with new provisions. Drug testing (restrictions apply) is permitted of employees 'engaged in the performance, supervision, or management of work in a hazardous work environment, security position, position affecting public safety, or fiducuary position... .' All drug and alchol testing procedures must be performed in accordance with 49 CFR, Part 40 of the Department of Transportation's regulations.
