Drug Testing Laws in the State of ColoradoWorkers' Compensation State law provides that workers' compensation benefits may be reduced by 50 percent when an injury results from the intoxication of an employee. It is presumed that the injury was due to the intoxication if the employee has 0.10 or more grams of alcohol per one hundred milliliters of blood or 0.10 or more grams of alcohol per two hundred ten liters of breath as shown by chemical analysis. This presumption may be overcome by clear and convincing evidence
