Drug Testing Laws in the State of Alaska

This Act is a voluntary law, which provides legal protection to employers who establish a program in compliance with the act. In order to receive the benefits of the law, employers must implement a comprehensive policy and must adhere to specific collection, testing, and confidentiality procedures. There are no restrictions placed on the types of testing that may be conducted (pre-employment, random, etc.). The act also permits the use of on-site testing provided the tests are administered by a certified test administrator and the testing products are approved by the FDA.

WORKERS COMPENSATION

Injuries proximately caused by the employee's intoxication or use of drugs are not compensable. Employers must present substantial evidence to overcome this presumption.
